Terms of Service

1. Introduction

Welcome to SplitSnap. These Terms of Service ("Terms") govern your use of the SplitSnap mobile application ("App"), provided by SplitSnap ("we," "us," or "our"). By downloading, installing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

SplitSnap is a receipt scanning bill-splitting application that allows users to scan receipts, process the information, and split bills among multiple people. All processing occurs on your device, and no data is transmitted to external servers.

2. Acceptance of Terms

By using SplitSnap, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the App after such changes constitutes your acceptance of the new Terms.

3. Eligibility

You must be at least 13 years old to use SplitSnap. By using the App, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent's or legal guardian's permission to use the App and that they have read and agree to these Terms on your behalf.

4. App License and Restrictions

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes.

You agree not to:

  • Modify, adapt, translate, reverse engineer, decompile, or disassemble the App
  • Remove any copyright, trademark, or other proprietary notices from the App
  • Use the App for any illegal purpose or in violation of any local, state, national, or international law
  • Interfere with or disrupt the operation of the App or servers
  • Attempt to gain unauthorized access to the App or its related systems
  • Use the App to transmit viruses, worms, or other malicious code
  • Use the App in any manner that could damage, disable, overburden, or impair it

5. User Responsibilities

As a user of SplitSnap, you are responsible for:

  • Ensuring the accuracy of the receipt information you scan
  • Verifying all calculations before finalizing bill splits
  • Maintaining the security of your device and preventing unauthorized access to the App
  • Complying with all applicable laws and regulations
  • Using the App in a manner that respects the privacy and rights of others

6. Receipt Processing and Financial Information

SplitSnap processes receipt information and performs calculations to split bills. You acknowledge and agree that:

  • All receipt processing occurs locally on your device
  • We do not store, access, or transmit your receipt data or financial information
  • The accuracy of the bill splitting depends on the quality of the receipt image and the accuracy of the optical character recognition (OCR) technology
  • You should always verify the results before finalizing any financial transactions
  • We are not responsible for any financial discrepancies or disputes that may arise from using the App

7. Intellectual Property Rights

The App, including its content, features, and functionality, is owned by SplitSnap and is protected by copyright, trademark, and other intellectual property laws. Our name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks or registered trademarks.

You may not use, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App, except as follows:

  • Your computer or mobile device may temporarily store copies of materials in RAM incidental to your accessing and viewing those materials
  • You may store files that are automatically cached by your web browser for display enhancement purposes
  • You may print or download one copy of a reasonable number of pages of the App for your own personal, non-commercial use and not for further reproduction, publication, or distribution

8. User-Generated Content

The App does not collect or store user-generated content on our servers. Any content you create or process within the App remains on your device and under your control. You retain all rights to such content.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will function without interruption or errors, that defects will be corrected, or that the App is free of viruses or other harmful components. We make no warranties regarding the accuracy, reliability, completeness, or timeliness of the App's content, including the accuracy of receipt scanning or bill splitting calculations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SPLITSNAP, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes, but is not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of data, loss of goodwill, or any other damages arising from:

  • Errors or inaccuracies in receipt scanning or bill splitting calculations
  • Financial disputes or discrepancies resulting from using the App
  • Interruption or cessation of transmission to or from the App
  • Any bugs, viruses, or other harmful code that may be transmitted through the App
  • Any unauthorized access to or use of our servers or any personal information stored therein

11. Indemnification

You agree to defend, indemnify, and hold harmless SplitSnap, its affiliates, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the App.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.

You may terminate your use of the App at any time by uninstalling it from your device. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in San Francisco County, California for the resolution of any disputes arising from these Terms or your use of the App.

14. Dispute Resolution

Any dispute arising from these Terms or your use of the App shall first be resolved through good-faith negotiations. If such negotiations fail, both parties agree to resolve the dispute through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in San Francisco, California, and the language of the arbitration shall be English.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be struck from these Terms, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SplitSnap regarding your use of the App and supersede all prior and contemporaneous written or oral agreements.
